Guard (Mahobho) jailed for stealing what he protects

The security guard, Barbatov Sibanda (38) of House Number 42036 Fusile Flats in Makokoba was charged together with his accomplice Aluta Siyapi of House Number 12 Oregon Road in Newton West under Chapter 9:13 of the Criminal Law Codification and Reform Act (unlawful entry into premises and theft).

Outlining the state case before Bulawayo magistrate, Mrs Thobekile Mkhosana-Matimbe at the Tredgold Magistrates Courts, the prosecutor Mr Clemence Shawarira said Sibanda was employed to guard the premises of Ecoweb Manufacturing Company in Bulawayo.

On 19 August, Sibanda together with Siyapi entered the packing room using duplicate keys where they took four boxes of two litre Triatix stock spray valued at US$512.

The crime came to light when the company officials were taking stock of the boxes. A report was made to Donnigton Police Station leading to Sibanda’s arrest who then implicated Siyapi. The two pleaded guilty to the offence and were sentenced to eight years of hard labour of which three years were suspended for five years on condition that they were not convicted of a similar offence in the said period.

Appearing before the same magistrate, Passwell Sibanda (23) and Lindisani Mathe (28) were remanded out of custody to 17 September for initial remand on charges of beating up Oscar Sate in a row over a calabash.

They were charged with assault as defined under Section 89 of the Criminal Law Codification and Reform Act chapter 9:23. The prosecutor, Mr Chawarira told the court that on 1 September 2009 the complainant knocked off from work and went to Mlamba bar in Trenance in the company of a friend. They joined the accused persons and drank together two calabashes and the complainant then bought one calabash to take home.

Mathe got hold of it. The four then left together and when Sate asked for a sip, Mathe refused and Sibanda joined in insisting that no one was going to drink the beer.

Sate then tried to take the calabash by force with the intent of emptying the contents but Sibanda started assaulting him with an unknown object several times on the head resulting in him falling down.

While on the ground Sibanda kicked him on the right eye and several times on the head, which resulted in him sustaining a cut on the head and a swollen eye. Sibanda admitted to the charges while Mathe denied the charges saying that he only rescued Sate.
